A influência da regulação e fiscalização da Lei Geral de Proteção de Dados (LGPD) na segurança e defesa cibernética no Brasil

Abstract

This academic paper addresses the role of the National Data Protection Authority (ANPD) in the regulatory and supervisory process of the Brazilian General Data Protection Law (LGPD) and its influence on cybersecurity and defense. The objective of this study is to assess how ANPD’s regulatory and sanctioning actions regarding the protection of personal data can enhance cybersecurity and defense in Brazil. To achieve this, research was conducted using scientific articles, documents, and regulations issued by the Authority, evaluating its performance, regulatory impact, and the supervision and sanctioning process. The study emphasizes the importance of the ANPD in protecting personal data and how its actions are fundamental to creating a culture of data protection in the country, ensuring compliance with the LGPD, and establishing a trusted environment for technological innovation. It critically analyzes ANPD's activities, and the challenges faced in fulfilling its institutional mission, and finally, explores future perspectives for the Authority. The study also evaluates actions that can be developed to improve personal data protection and enhance cybersecurity and cyber defense in Brazil.
