Inter-relações entre o poder legislativo e a defesa nacional: aspectos históricos e jurídicos da logística e da mobilização nacional

Abstract

This work explores the historical evolution of logistics and national mobilization in association with the current regulation at the time. It seeks to understand the interrelationships between the Legislative Branch and the National Defense. The aim is to comprehend the role of the National Congress and the Executive Branch, particularly the Ministry of Defense, in normative regulation, as well as to identify some possible gaps and aspects which ask for corrections in the legislative process. As a result, there is a need for the issuance of updated legislation on logistics and national mobilization and national mobilization considering its extension to the field of civil defense; and the need to align legislation with methods for obtaining logistical resources, particularly requisition and also the need for corrections in the regulation process referring to the National Defense Policy, to the National Defense Strategy, and to the National Defense White Book.
