| Abstract: | This monograph addresses the chain of custody as the primary element in ensuring the suitability of the traces of a crime. The objective of this study is, from the diagnosis of the situation of the application of the chain of custody in Brazil, to provide subsidies that serve as a basis for the implementation of a methodology for the chain of custody of automotive vehicles. The chain of custody had been neglected in Brazil, however, recently, the concept of chain of custody was inserted in the Code of Criminal Procedure through Law No. 13.964/2019. The execution of the chain of custody, as defined in the aforementioned Law, is carried out in several stages, two of which, packaging and storage, present obstacles to be overcome when the artifact to be inspected has large dimensions, such as motor vehicles and the like. The chain of custody for such objects is still carried out in such a way that it is impracticable to guarantee the suitability of the material evidence for this case. It is common to use motor vehicles in the commission of various crimes, when not, the vehicle itself is the object of the crime. Many of these crimes, such as drug trafficking, are transnational, generating threats to national security and defense. Considering that the use of vehicles whose identifying signs were altered in the commission of these crimes is frequent, it is urgent to improve the chain of custody in order to guarantee the suitability of the material evidence. In this study, the starting point was the examination of the implementation stage of the chain of custody in the agencies responsible for its execution, notably in the packaging and storage of motor vehicles, identifying its structural, logistical and personnel difficulties. In particular, an analysis of the methodological flow employed by the Scientific Police of Rio Grande do Norte was carried out. Finally, a feasible methodology for the chain of custody of automotive and similar vehicles is proposed. |
| Description: | A presente monografia aborda a cadeia de custódia como o elemento primordial na garantia da idoneidade dos vestígios de um crime. O objetivo deste estudo é, a partir do diagnóstico da situação da aplicação da cadeia de custódia no Brasil, fornecer subsídios que sirvam de base para a implementação de uma metodologia para cadeia de custódia de veículos automotores. A cadeia de custódia vinha sendo negligenciada no Brasil, porém, recentemente, o conceito de cadeia de custódia foi inserido no Código de Processo Penal através da Lei nº 13.964/2019. A execução da cadeia de custódia, conforme definido na citada Lei, é realizada em várias etapas, sendo que duas destas, o acondicionamento e o armazenamento, apresentam embaraços a serem superados quando o artefato a ser periciado possui dimensões avantajadas, tais como os veículos automotores e assemelhados. A cadeia de custódia para tais objetos ainda é executada de forma que se torna inviável garantir a idoneidade da prova material para este caso. É corriqueira a utilização de veículos automotores na prática de diversos crimes, quando não, o próprio veículo é o objeto do crime. Muitos destes crimes, como o tráfico de entorpecentes, são transnacionais, gerando ameaças à segurança e à defesa nacionais. Considerando ser frequente a utilização de veículos cujos sinais identificadores foram adulterados na prática destes crimes, torna-se premente o aperfeiçoamento da cadeia de custódia de modo a garantir a idoneidade da prova material. Neste estudo, o ponto de partida foi o exame do estágio de implantação da cadeia de custódia nos órgãos responsáveis pela sua execução, notadamente no acondicionamento e armazenamento de veículos automotores, identificando suas dificuldades de ordem estrutural, logística e de pessoal existentes. Em especial, foi realizada a análise do fluxo metodológico empregado pela Polícia Científica do Rio Grande do Norte. Por fim, é proposta uma metodologia exequível para a cadeia de custódia de veículos automotores e assemelhados. |
