| Abstract: | The Federative Republic of Brazil is a country that in addition to it‘s large territory is a nation with a sizeable industry, large oil reserves, strategic minerals, rich biodiversity, great reserves of potable water in Alter do Chão and Guarani aquifers, as well as a major producer and exporter of foodstuff. Moreover, the country has a population of approximately 204 million inhabitants. It is therefore essential that Brazil worry about having a Brazilian Defense Industry that can bring scientific and technological development and contribute to improve socio-economic conditions of the nation.The fundamental objective of this work is the study of Brazilian law currently in force in the field of Public and Private Rights, relevant to the Brazilian Defense Industry (BID), in view of the National Defence Policy (PND), the National Strategy Defense (END), and the National Defense White Book. Therefore, the legal aspects will be analyzed that help to strengthen the Brazilian Defense Industry (BID) in the country and in particular the main legal aspects of the BID Development Law (Law Nº. 12.598 / 2012) and the regulatory decrees. To conclude, and also will be checked certain obstacles that eventually need to be overcome to occur the full development of the Brazilian Defense Industry. |
| Description: | A República Federativa do Brasil é um país que, além da grande extensão territorial, é uma nação com um parque industrial considerável, grandes reservas de petróleo, minérios estratégicos, riquíssima biodiversidade, grande quantidade de água potável nos aquíferos Alter do Chão e Guarani, bem como um grande produtor e exportador de alimentos. Ademais, o país possui uma população de aproximadamente 204.000.000 de habitantes. Portanto, é fundamental que o Brasil se preocupe em ter uma Base Industrial de Defesa (BID) que possa trazer desenvolvimento científico e tecnológico e que contribua para a melhoria das condições sócioeconômicas da nação. O objetivo fundamental do presente trabalho é o estudo da legislação brasileira atualmente em vigor, no campo dos Direitos Público e Privado, pertinente com a Base Industrial de Defesa – BID brasileira, tendo em vista a Política Nacional de Defesa (PND), a Estratégia Nacional de Defesa (END) e o Livro Branco de Defesa. Assim sendo, são analisados os aspectos legais que ajudam a fortalecer a Base Industrial de Defesa – BID no país e, em especial, os principais aspectos legais da Lei de Fomento da BID (Lei nº 12.598/2012) e seus respectivos decretos regulamentadores. Finalmente, são verificados os óbices que eventualmente precisam ser superados, para que ocorra o pleno desenvolvimento da BID no Brasil. |
